Health Care Law

 

 

Health care law today is a cutting-edge specialty.  The past two decades have brought dramatic changes in health care delivery, government regulation, reimbursement and competition for services.  Florida, with its elderly population and exploding census, is the setting for intense and tangled industry activity.  Phil Blank served as chairman of the Florida Bar Health Law Committee, is certified by the Florida Bar in Health Law, is a member of the American Academy of Hospital Attorneys and served as member of the Statewide Health Council.  His publications have been cited in opinions by the First District Court of Appeal.

 

To become board certified in health law, an applicant must have practiced for at least five years prior to the application deadline, currently October 31 each year.  Their practice during the three years preceding the application date needs to be predominately dedicated to health law issues.  An applicant must have also completed at least 60 hours of approved intermediate or advanced health law certification courses. 

 

There are currently 113 board certified health lawyers in Florida. 

 

Whether the issue is obtaining a certificate of need for any type of bed or service, representing health care clients facing federal or state administrative sanctions, Medicaid recoupment, advice on environmental and hazardous waste issues, acquisitions or advising clients in the ever expanding area of fraud and abuse, our firm is a recognized leader in its area of practice.  We represent hospitals, nursing homes, hospice organizations, home health agencies, physicians and HMOs throughout the state.  We have successfully represented clients with alleged EMTALA violations and false claims filings, and on questions of state anti-referral laws and Stark II.

 

When the State of Florida Agency for Health Care Administration required assistance to resolve sensitive matters between rival hospitals, it turned to our firm to mediate a resolution satisfactory to all parties.  Likewise, when the Department of Health and Rehabilitative Services needed outside counsel to assist on complex litigation involving millions of dollars, it turned to our firm for counsel.
